Garage Cycles Test Ride Terms, Conditions, Assumption of Risk, Release of Liability, and Payment Authorization

These Garage Cycles Test Ride Terms, Conditions, Assumption of Risk, Release of Liability, and Payment Authorization are entered into between the customer and brightDigital LLC dba Garage Cycles / GarageCycles.cc.

Throughout these terms, “Garage Cycles,” “we,” “us,” and “our” refer to brightDigital LLC dba Garage Cycles / GarageCycles.cc.

Agreement Date: The effective date and time of this agreement is the date and time the customer submits the related test ride form, reservation, waiver, checkout form, payment authorization, or electronic acceptance referencing these terms.

Thank you for choosing Garage Cycles. We want your test ride to be safe, simple, and enjoyable. These terms explain what you are agreeing to when you submit a test ride form, schedule a demo, take possession of a bicycle, e-bike, accessory, helmet, lock, battery, charger, or other equipment from Garage Cycles, or participate in a Garage Cycles test ride, demo ride, rental, group ride, event, or related activity.

By submitting the test ride form, checking the agreement box, signing electronically or physically, providing payment information, or participating in the test ride or demo, you agree to the following terms.

1. Agreement to Participate

I understand that I am requesting permission to test ride, demo, rent, borrow, handle, use, or otherwise participate in an activity involving one or more bicycles, electric bicycles, components, accessories, helmets, locks, batteries, chargers, tools, or related equipment provided by Garage Cycles.

For purposes of this agreement, “Test Ride” means any ride, demo, inspection, handling, use, or possession of Garage Cycles equipment, whether on public roads, sidewalks, bike lanes, paths, trails, parking lots, private property, events, or any other area.

“Equipment” means any bicycle, electric bicycle, frame, wheel, tire, drivetrain, brake, battery, charger, helmet, lock, bag, rack, child seat, trailer, tool, accessory, or other item provided by Garage Cycles.

2. Rider Eligibility

I represent that:

  1. I am at least 18 years old, unless Garage Cycles has separately approved participation by a minor with a parent or legal guardian present.
  2. I am physically and mentally able to safely participate in a Test Ride.
  3. I know how to operate a bicycle safely.
  4. I will not ride while impaired by alcohol, cannabis, illegal drugs, prescription medication that affects my ability to ride, fatigue, illness, or any other condition that could make riding unsafe.
  5. I will provide accurate contact, identification, and payment information.
  6. I will comply with all applicable traffic laws, helmet rules, trail rules, posted signs, and instructions from Garage Cycles staff.

Garage Cycles may refuse, cancel, or end a Test Ride at any time if Garage Cycles believes participation would be unsafe, inappropriate, unlawful, or inconsistent with these terms.

3. Safety Rules

I agree to use reasonable care and good judgment at all times. I agree that I will:

  1. Inspect the Equipment before riding and immediately report anything that feels loose, damaged, unusual, or unsafe.
  2. Ask Garage Cycles staff for instructions before riding if I am unfamiliar with the bike, e-bike controls, brakes, gears, throttle, pedal assist, display, battery, lock, or any other feature.
  3. Wear a properly fitted helmet if required by Garage Cycles, law, event rules, or my own judgment.
  4. Keep both hands available for control unless signaling.
  5. Ride at a safe speed for the conditions.
  6. Maintain a safe distance from cars, pedestrians, riders, animals, curbs, obstacles, and other hazards.
  7. Obey all traffic laws and signals.
  8. Not carry passengers unless the Equipment is specifically designed and approved for that purpose.
  9. Not perform jumps, tricks, racing, stunts, curb drops, aggressive riding, or off-road riding unless Garage Cycles has specifically approved that use in writing.
  10. Not modify, adjust, disassemble, damage, misuse, or tamper with the Equipment.
  11. Not leave the Equipment unattended unless it is properly locked in a safe location approved by Garage Cycles.
  12. Return the Equipment by the agreed return time and location.

4. E-Bike Specific Terms

If the Test Ride involves an electric bicycle, I understand that e-bikes may accelerate faster, weigh more, require longer stopping distances, and handle differently than non-electric bicycles.

I agree that I will:

  1. Start in a low assist mode until I am comfortable.
  2. Keep my speed controlled.
  3. Avoid sudden acceleration near people, vehicles, intersections, driveways, dogs, children, curbs, and obstacles.
  4. Use extra caution when braking, cornering, mounting, dismounting, and riding downhill.
  5. Not remove, open, alter, damage, misuse, charge, or tamper with the battery, motor, wiring, display, controller, charger, or electronic system.
  6. Follow all e-bike class, trail, road, sidewalk, and path rules.

5. Assumption of Inherent Risks

I understand that bicycling, e-biking, test riding, demo riding, and related activities involve inherent and unavoidable risks. These risks exist even when the Equipment is in good condition, even when safety rules are followed, and even when Garage Cycles, its staff, or others act carefully.

Risks may include, but are not limited to:

  1. Falling, crashing, losing balance, or losing control.
  2. Collisions with vehicles, cyclists, pedestrians, animals, curbs, signs, poles, road debris, potholes, gravel, ice, snow, water, oil, tracks, construction zones, doors, or other hazards.
  3. Mechanical failure, tire puncture, brake issues, drivetrain issues, battery issues, electrical issues, or unexpected equipment behavior.
  4. Weather, wind, heat, cold, poor visibility, darkness, sun glare, or changing road and trail conditions.
  5. Actions or inactions of drivers, pedestrians, cyclists, animals, property owners, event participants, or other third parties.
  6. Injuries including cuts, bruises, sprains, strains, fractures, dental injuries, head injuries, traumatic brain injuries, spinal injuries, paralysis, heart events, serious bodily injury, or death.
  7. Property damage, loss, theft, or damage to personal items.

I knowingly and voluntarily accept these risks.

6. Release of Liability

To the fullest extent allowed by Utah law, I agree to release, waive, discharge, and not sue Garage Cycles, brightDigital LLC, GarageCycles.cc, and their owners, members, managers, officers, employees, contractors, mechanics, instructors, ride leaders, volunteers, affiliates, vendors, manufacturers, landlords, property owners, sponsors, partners, insurers, successors, and assigns, collectively referred to as the “Released Parties,” for any claim, demand, loss, injury, death, property damage, cost, expense, or cause of action arising out of or related to my Test Ride, participation, use of Equipment, presence at Garage Cycles, or presence at any related event or location.

This release includes, but is not limited to, claims arising from the ordinary negligence of any Released Party.

This release does not apply to claims that cannot legally be released under Utah law, including claims arising from willful misconduct, gross negligence, or any other liability that Utah law does not allow to be waived.

I understand that I am giving up important legal rights by agreeing to this release.

7. Indemnification

I agree to defend, indemnify, and hold harmless the Released Parties from and against any claim, demand, lawsuit, liability, loss, damage, cost, or expense, including reasonable attorney fees, arising out of or related to:

  1. My participation in a Test Ride.
  2. My use, misuse, possession, loss, theft, or damage of Equipment.
  3. My violation of these terms.
  4. My violation of any law, rule, traffic regulation, trail rule, event rule, or instruction.
  5. Injury or damage I cause to myself, another person, another rider, a pedestrian, a vehicle, property, or personal belongings.
  6. Any inaccurate information I provide to Garage Cycles.
  7. Any claim brought by a third party arising from my conduct.

8. Responsibility for Equipment

I accept full responsibility for the Equipment from the time it is released to me until it is returned to and accepted by Garage Cycles.

I agree to return the Equipment:

  1. In the same condition as received, ordinary wear from approved use excepted.
  2. By the agreed return time.
  3. To the agreed return location.
  4. Directly to Garage Cycles staff unless Garage Cycles gives written permission for another return method.

I agree not to lend, transfer, rent, sell, pledge, abandon, hide, or allow any other person to use the Equipment without Garage Cycles’ prior written approval.

9. Damage, Loss, Theft, and Late Return

I understand that I am financially responsible for damage, loss, theft, disappearance, excessive wear, missing parts, late return, or failure to return the Equipment.

This responsibility applies whether the issue is caused by accident, carelessness, misuse, theft, vandalism, improper locking, improper storage, transportation, weather exposure, collision, crash, third-party conduct, or any other cause while the Equipment is in my possession or control.

Charges may include, without limitation:

  1. Repair labor.
  2. Replacement parts.
  3. Diagnostic time.
  4. Cleaning fees for excessive dirt, mud, odor, food, drink, biohazard, or unusual mess.
  5. Battery, charger, key, lock, helmet, accessory, or component replacement.
  6. Loss of use while the Equipment is unavailable for sale, rental, demo, or service.
  7. Recovery, pickup, delivery, towing, transportation, or retrieval costs.
  8. Administrative costs related to loss, theft, damage, chargebacks, collections, police reports, insurance claims, or legal enforcement.
  9. Full retail replacement value if Equipment is lost, stolen, not returned, destroyed, materially altered, or damaged beyond reasonable repair.

Garage Cycles may determine whether Equipment should be repaired or replaced based on safety, manufacturer guidance, parts availability, resale condition, warranty impact, and reasonable business judgment.

10. Payment Authorization

I authorize Garage Cycles to keep my payment method on file and to charge my card, digital wallet, or other payment method for amounts owed under these terms.

Authorized charges may include:

  1. Test ride, demo, rental, or event fees.
  2. Deposits or holds.
  3. Late fees.
  4. Damage charges.
  5. Loss, theft, or replacement charges.
  6. Cleaning charges.
  7. Recovery or transportation charges.
  8. Failure-to-return charges.
  9. Collection costs.
  10. Any other amounts I owe under these terms.

If Garage Cycles charges my payment method for damage, loss, theft, late return, or failure to return, Garage Cycles will make reasonable efforts to document the charge and provide an explanation upon request.

I agree not to dispute or charge back valid charges made under this authorization. If I initiate an improper chargeback, I agree to reimburse Garage Cycles for the amount charged back, plus any processor fees, bank fees, collection costs, and reasonable attorney fees.

If my payment method is declined, I agree to provide another valid payment method immediately.

11. Deposits and Card Holds

Garage Cycles may require a deposit, preauthorization, or card hold before releasing Equipment.

A card hold is not necessarily a final charge. The actual amount charged may be less than, equal to, or greater than the hold depending on the final amount owed.

Garage Cycles may release or adjust holds after Equipment is returned and inspected. Timing of release may depend on the payment processor, card issuer, or bank.

12. Pricing for Damage or Replacement

Unless Garage Cycles provides a specific damage schedule, I agree that charges may be based on:

  1. Current retail price of the item or comparable replacement.
  2. Manufacturer suggested retail price.
  3. Garage Cycles’ normal service labor rate.
  4. Vendor replacement cost plus reasonable margin and freight.
  5. Reasonable used-value adjustment when Garage Cycles determines replacement with new equipment is not required.
  6. Actual cost of repair, replacement, recovery, cleaning, or loss of use.

For e-bikes, I understand that batteries, displays, motors, controllers, wiring harnesses, frames, forks, wheels, and hydraulic brakes may be expensive to repair or replace.

13. Theft or Failure to Return

If Equipment is not returned at the agreed time and Garage Cycles is unable to reach me or recover the Equipment promptly, Garage Cycles may treat the Equipment as missing, lost, or stolen.

Garage Cycles may:

  1. Charge my payment method for late fees, recovery costs, and replacement value.
  2. Contact emergency contacts or references I provided.
  3. Use location, device, serial number, or identifying information to locate the Equipment.
  4. Report the Equipment as lost or stolen to law enforcement.
  5. Cooperate with law enforcement, insurers, payment processors, and collection providers.
  6. Pursue civil, criminal, insurance, or collection remedies.

I agree that failure to return Equipment may cause Garage Cycles financial loss beyond the rental or test ride fee.

14. Personal Property

I am responsible for my own phone, wallet, keys, glasses, clothing, bags, vehicles, accessories, and other personal property. Garage Cycles is not responsible for lost, stolen, or damaged personal items unless required by law.

15. No Guarantee of Purchase, Availability, Fit, or Performance

A Test Ride is intended to help me experience a bike or product. Garage Cycles does not guarantee that:

  1. A specific bike, size, color, model, build, accessory, or price will remain available.
  2. A Test Ride will perfectly predict long-term comfort, range, fit, performance, maintenance needs, or suitability.
  3. An e-bike’s battery range will match any estimate, advertisement, display reading, or manufacturer claim, because range depends on rider weight, speed, assist level, terrain, wind, temperature, tire pressure, cargo, riding style, and other conditions.

Garage Cycles staff may provide product guidance, but final purchase decisions are my responsibility.

16. Health and Medical Acknowledgment

I understand that bicycling and e-biking may be physically demanding. I am responsible for determining whether I am healthy enough to participate.

I certify that I do not have any medical, physical, mental, vision, balance, medication-related, or other condition that would make participation unsafe for me or others.

I agree that Garage Cycles has no duty to evaluate my medical fitness.

17. Emergency Medical Care

If I am injured or appear to need emergency assistance, I authorize Garage Cycles and its staff to contact emergency services. I understand Garage Cycles is not required to provide medical care and may not have medical personnel available.

I am responsible for my own medical costs, ambulance costs, emergency care costs, and related expenses.

18. Identification and Verification

Garage Cycles may require a valid government-issued ID, payment card, phone number, email, address, photograph, signed form, or other verification before releasing Equipment.

Garage Cycles may refuse to release Equipment if identification, payment, or verification cannot be reasonably confirmed.

19. Photo, Video, and Marketing Release

Unless I notify Garage Cycles in writing before the Test Ride, I grant Garage Cycles permission to photograph, film, or otherwise capture my image, likeness, voice, name, bike, vehicle, or participation in connection with the Test Ride, store, event, or related activity.

Garage Cycles may use this content for business, marketing, social media, website, advertising, training, internal, or promotional purposes without additional payment to me.

This section does not require me to post, endorse, or review Garage Cycles.

20. Privacy and Communications

I authorize Garage Cycles to contact me by phone, text, email, or other provided contact method regarding:

  1. My Test Ride.
  2. Scheduling.
  3. Safety or return issues.
  4. Damage, loss, theft, or payment issues.
  5. Product information related to my inquiry.
  6. Follow-up offers or service reminders, where permitted by law.

Message and data rates may apply. I may opt out of marketing messages where required by law, but Garage Cycles may still send transactional messages related to my Test Ride, Equipment, payments, safety, or account.

21. Minors

Garage Cycles generally requires Test Ride participants to be at least 18 years old.

If Garage Cycles allows a minor to participate, the minor’s parent or legal guardian must be present, must sign any required documents, and must accept financial responsibility for the minor’s use of Equipment, including damage, loss, theft, late return, and injury or damage caused by the minor.

Nothing in this agreement is intended to waive rights that Utah law does not allow a parent or guardian to waive on behalf of a minor.

22. Customer Courtesy and Staff Authority

Garage Cycles wants every Test Ride to feel welcoming and respectful. I agree to follow reasonable instructions from Garage Cycles staff.

Garage Cycles may end a Test Ride, refuse future rides, or require immediate return of Equipment if I act in a way that Garage Cycles reasonably believes is unsafe, abusive, dishonest, threatening, discriminatory, unlawful, or harmful to Garage Cycles, its staff, customers, property, or community.

23. Mechanical Condition and Inspection

Garage Cycles makes reasonable efforts to provide Equipment in safe working condition. However, bicycles and e-bikes are mechanical products and can experience unexpected issues.

Before riding, I agree to perform a basic check of the Equipment, including brakes, tires, steering, saddle, pedals, wheels, controls, and overall feel. If anything seems wrong, I will stop riding immediately and contact Garage Cycles.

I understand that continuing to ride after noticing a problem may increase the risk of injury or damage and may make me responsible for resulting damage.

24. Route and Riding Area

Garage Cycles may recommend a route or riding area, but I remain responsible for riding safely and lawfully.

Unless Garage Cycles approves otherwise in writing, I agree not to take Equipment:

  1. Outside the approved Test Ride area.
  2. Onto trails or terrain not approved for that Equipment.
  3. Into restricted, closed, private, or unlawful areas.
  4. In a vehicle or public transit.
  5. To another city, county, state, or country.
  6. To any race, jump line, downhill trail, bike park, competition, or stunt area.

25. No Warranty During Test Ride

The Equipment is provided for temporary test ride, demo, rental, or evaluation purposes. To the fullest extent allowed by law, Garage Cycles makes no express or implied warranties in connection with the Test Ride, including implied warranties of merchantability or fitness for a particular purpose.

This does not limit any manufacturer warranty that may apply to a product purchased separately.

26. Limitation of Liability

To the fullest extent allowed by law, Garage Cycles will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to a Test Ride, including lost time, lost income, inconvenience, emotional distress, missed opportunities, travel costs, or loss of use.

27. Insurance

I understand that Garage Cycles does not provide personal accident insurance, health insurance, bicycle insurance, theft insurance, property insurance, or liability insurance for me.

My own health, homeowner’s, renter’s, auto, umbrella, credit card, or other insurance may or may not provide coverage. I am responsible for understanding my own coverage.

28. Dynamic Agreement Date and Electronic Signature

The date and time of this agreement is the date and time recorded by Garage Cycles’ form, reservation system, checkout system, payment processor, e-signature system, or other electronic record when I submit the related form, accept these terms, provide payment information, or participate in the Test Ride.

I agree that submitting a form, checking an agreement box, clicking an acceptance button, signing electronically, providing payment information, or participating in the Test Ride may serve as my electronic signature and acceptance of these terms.

I agree that my electronic agreement has the same effect as a handwritten signature.

29. Governing Law and Venue

This agreement is governed by the laws of the State of Utah, without regard to conflict-of-law rules.

Any dispute arising out of or related to this agreement, the Equipment, or a Test Ride shall be brought in the state or federal courts located in Salt Lake County, Utah, unless a different venue is required by law.

30. Severability

If any part of this agreement is found to be invalid, unlawful, or unenforceable, the remaining parts will remain in effect to the fullest extent allowed by law.

If any provision is found to be too broad, it shall be modified to the minimum extent necessary to make it enforceable while preserving its purpose as closely as possible.

31. Entire Agreement

This agreement, together with any test ride form, rental form, invoice, receipt, payment authorization, product page, or written instructions provided by Garage Cycles, is the entire agreement between me and Garage Cycles regarding the Test Ride.

If there is a conflict between this agreement and a shorter form, waiver, or checkout notice, this agreement controls unless Garage Cycles expressly states otherwise in writing.

32. Acknowledgment

By submitting the Test Ride form, signing, checking the agreement box, providing payment information, or participating in the Test Ride, I acknowledge that:

  1. I have read and understood these terms.
  2. I had the opportunity to ask questions before participating.
  3. I understand the risks of bicycling and e-biking.
  4. I voluntarily assume those risks.
  5. I am releasing Garage Cycles and the Released Parties from claims, including claims based on ordinary negligence, to the fullest extent allowed by Utah law.
  6. I accept financial responsibility for damage, loss, theft, late return, and failure to return Equipment.
  7. I authorize Garage Cycles to charge my payment method for amounts owed under these terms.
  8. I agree that the effective date and time of this agreement is the date and time recorded with my form submission, reservation, payment authorization, electronic acceptance, or participation.
