Test Ride Agreement, Assumption of Risk, Release of Liability & Payment Authorization

Thank you for choosing Garage Cycles. Before participating in a test ride, demo ride, or rental experience, customers are required to review and agree to the following terms and conditions.

These terms are designed to ensure a safe experience for all riders while protecting both the customer and brightDigital LLC DBA Garage Cycles.

By requesting a test ride, checking the agreement box, providing required information, or participating in a test ride, you confirm that you have read, understood, and agreed to these terms.

1. Test Ride Agreement

By participating in a Garage Cycles test ride, I acknowledge that I am being provided an opportunity to test, inspect, and operate a bicycle or e-bike before making a purchase decision.

I understand that the test ride may involve operating equipment in real-world conditions, including roads, bike paths, parking areas, trails, or other approved riding locations.

The equipment provided may include:

Bicycles
Electric bicycles
Batteries
Chargers
Accessories
Safety equipment
Other related products provided by Garage Cycles

2. Customer Eligibility & Responsibility

To participate in a test ride, I confirm that:

I am legally allowed to operate the bicycle or e-bike being tested.
I have the physical ability and experience required to safely operate the equipment.
I will provide accurate contact and identification information when requested.
I will follow all instructions provided by Garage Cycles staff.
I will comply with all applicable traffic laws and safety requirements.
I will not participate while under the influence of alcohol, drugs, or any substance that affects my ability to safely operate the equipment.

Garage Cycles reserves the right to refuse or stop a test ride if the rider's behavior creates an unsafe situation.

3. Safety Requirements

During the test ride, I agree to:

Ride responsibly and maintain control of the bicycle or e-bike at all times.
Follow all traffic laws and local riding regulations.
Ride at a safe speed based on conditions.
Be aware of vehicles, pedestrians, other riders, and obstacles.
Use caution when starting, stopping, turning, and operating electric assistance.
Follow all instructions provided by Garage Cycles representatives.
Return the equipment immediately if instructed by Garage Cycles.

I will not:

Perform dangerous riding activities.
Race, jump, or perform stunts.
Allow another person to use the equipment.
Modify or damage the bicycle or e-bike.
Misuse any equipment provided.

4. E-Bike Test Ride Requirements

I understand that electric bicycles may operate differently from traditional bicycles due to motor assistance, increased weight, and acceleration.

When testing an e-bike, I agree to:

Become familiar with the controls before riding.
Start with a lower assistance level when necessary.
Maintain safe speeds.
Use additional caution while braking and turning.
Avoid sudden acceleration in unsafe areas.
Not modify, remove, or damage any electrical components, including the battery, motor, display, wiring, or charger.

5. Assumption of Risk

I understand that bicycle and e-bike riding involves risks, including but not limited to:

Falls
Loss of control
Collisions
Road hazards
Weather conditions
Mechanical issues
Personal injury
Property damage

I voluntarily accept responsibility for these risks while participating in a Garage Cycles test ride.

6. Release of Liability

To the fullest extent permitted by applicable law, I release and hold harmless:

brightDigital LLC DBA Garage Cycles, including its owners, employees, representatives, contractors, and affiliates.

This release applies to claims, injuries, damages, losses, or expenses resulting from:

My participation in a test ride.
My use of Garage Cycles equipment.
My actions while operating the bicycle or e-bike.

I understand that this agreement does not waive responsibilities that cannot legally be waived.

7. Equipment Responsibility

I understand that I am responsible for the equipment provided to me during the test ride.

I agree to:

Use the equipment only as intended.
Keep the equipment secure.
Prevent unauthorized use.
Return all equipment in the same condition it was provided.

I understand that I may be responsible for damage, loss, theft, or missing equipment resulting from misuse, negligence, or failure to return the equipment.

8. Damage, Loss & Replacement Costs

If equipment is damaged, lost, stolen, or not returned, Garage Cycles may charge reasonable costs associated with:

Repairs
Replacement parts
Missing accessories
Recovery expenses
Replacement value of equipment

Garage Cycles will provide details regarding any applicable charges.

9. Payment Authorization

By agreeing to these terms, I authorize Garage Cycles to charge my provided payment method for valid charges related to:

Damage to equipment
Lost or stolen equipment
Missing accessories
Failure to return equipment
Other approved charges related to the test ride agreement

10. Customer Information & Verification

Garage Cycles may request customer information before providing equipment, including:

Name
Phone number
Email address
Identification information
Payment information

This information may be used to manage test rides, communicate updates, and process applicable charges.

11. Marketing & Photo Permission

By participating in a Garage Cycles test ride, I understand that photos or videos may be captured for promotional purposes.

Garage Cycles may use approved photos or videos for:

Website content
Social media
Marketing campaigns
Promotional materials

12. Electronic Customer Agreement

Before completing a test ride request, customers must confirm that they have reviewed and agreed to these terms.

By submitting a test ride request and accepting these terms, I confirm that:

I have read and agree to the Garage Cycles Test Ride Terms & Conditions.
I understand the risks associated with bicycle and e-bike riding.
I accept responsibility for the equipment provided during my test ride.
I authorize Garage Cycles to charge valid costs related to damage, loss, theft, or failure to return equipment.
I understand that my electronic acceptance serves as my agreement to these terms.
